ELWa is now part of the Department for Children, Education, Lifelong Learning and Skills within the Welsh Assembly Government. ELWa was an Assembly Sponsored Public Body established under the Learning and Skills Act 2000. It's statutory name is the National Council for Education and Training for Wales.

On April 1st 2001, it took over the majority of the functions of the four Training and Enterprise Councils and the Further Education Funding Council for Wales. It assumed responsibility for funding, planning and promoting all post-16 education and training in Wales with the exception of Higher Education.

ELWa has responsibility for further education, private and voluntary sector training provision, adult continuing education and sixth form provision and in “Making Learning Work for You” it provides:
